1. GENERAL CLAUSES
The purpose of these General Terms and Conditions of Sale (hereinafter referred to as GTC) is to specify the performance and settlement clauses applicable to the commercial relationship between LAMETRAD s.a.r.l with a share capital of €7,500 registered with the R.C.S. of Toulouse under No. 810 354 795, whose registered office is located at 15 avenue de Balardou, 31820 Pibrac France (hereinafter referred to as the company) and its customers (hereinafter referred to as the customer or the buyer)


2. APPLICATION
The present GTC apply to any order of products addressed by the customer to the company, to its representative or on its site, the act of purchase entraining acceptance of the present GTC.
The present GTC prevail over any other general conditions which could be opposed to them.
The company reserves the right to update annually or periodically the present GTC; they are applicable as soon as the customer is informed of them in an appendix to our price list and/or their posting on our website, and the customer is called upon to take cognizance of them before any order.


3. DESCRIPTION AND GUARANTEE OF THE PRODUCTS
The products are in conformity with the legislation and the standards in force.
The guarantee of our products is a manufacturer's guarantee, it does not cover the risks and the consequences due to a use not in conformity with the use for which the product is intended.
The products offered for sale are those presented in our catalogs and on our website and this within the limits of available stocks. The photos of the products are not contractual. If an error is noted on the photographs, the prices or the texts the company will inform the customer as soon as possible.
In case of unavailability of one of the products or non-renewal of a product, the company will be able to substitute it by a similar product of at least equivalent value and quality.


4. PRICES
The prices indicated in our tariffs are in Euros excluding VAT for any order of products addressed by the customer to the company, or to its representative.
The VAT in force will be applied in addition on the invoice.
They are given as an indication and can be modified without notice.
The prices indicated on our website are the prices valid on the day the order is accepted. They are in Euros, including VAT.
If the VAT rate were to be modified, it will be immediately reflected in the prices.
The prices indicated do not take into account the shipping costs and are ex our warehouse, the shipping costs will be charged in addition.


5. TERMS OF PAYMENT
The terms of payment are those imposed on all French companies by the law N° 2008-776 of 4/8/2008 (LME) the term agreed between the parties cannot exceed 30 days from the date of receipt of the goods.
Any missed deadline will lead to the collection of 1.5% of the amount of the invoice per month of delay without the need for a reminder, and in addition, a flat fee of 40€ will be required for collection costs.
The payment of the orders bound for the DOM TOM and with Export is carried out by bank transfer in integrality and before any forwarding.
For online sales, payments are made by PAYPAL and Pay-line
The accepted bank cards are the French cards having the sign CB and the international cards VISA and Mastercard and must carry the name of the person who places the order.
In case of non-payment or fraudulent use of a bank card, the information will be transmitted to the public prosecutor's office for investigation.
In any case, the company reserves the right to refuse any order or shipment if the limits granted to its customers are exceeded.


6. OBLIGATION OF THE CUSTOMER
The customer declares to be at least 18 years old and to have the legal capacity or to be holder of a parental authorization allowing him to place an order on the site.
The customer undertakes to provide accurate and personal information, in particular his surname, first name, address, telephone number, bank details and valid e-mail.
The customer is responsible for the consequences resulting from false or inaccurate information transmitted or whose use will be illicit.
Professional customers with a website can resell "Lames & Tradition" products on their website, however they are obliged not to distribute these products on any other online sales site without our prior agreement.


7. ORDER PROCESSING
The online order is validated only after full payment
The order will be processed within 7 working days from the validation of the order by the company, to which should be added the time of shipment by colissimo.


8. RIGHT OF WITHDRAWAL
Only in the case of distance selling and in accordance with Article L.121-20 of the Consumer Code, the buyer has the right to return the product in its original packaging.
